Terms of Service

Agreement to these terms: SUDAKAI is an independent brand by Anh, operating the store at sudakai.co. By visiting the site, browsing the shop, or placing an order, you agree to these Terms of Service and to our Refund Policy, Shipping Policy, and Privacy Policy, which are part of these terms. Where a specific product page, promotion, or policy says something more detailed, that more specific term controls for that situation. If you do not agree, please do not use the site.
Who can use the site: You must be at least 13 years old to browse sudakai.co. To place an order you must be at least 18, or the age of majority where you live, or have a parent or guardian handle the purchase for you. By ordering, you confirm that the information you give us is accurate and that you're allowed to use the payment method you provide.
Changes to these terms: We may update these terms, and our other policies, from time to time as the shop grows or the law changes. The current version always lives on this page, and the "last updated" date at the bottom shows when it last changed. Updates apply going forward, and continuing to use the site after a change means you accept the revised terms.
The online store: Our shop runs on Shopify together with other trusted third-party providers for payments, hosting, and similar services. You agree not to misuse the site — including using bots, scrapers, or automated tools, attempting to gain unauthorized access, interfering with how the site works, or copying the site for a competing service.
Your account: If you create a customer account during checkout, you're responsible for keeping your login details secure and for activity that happens under your account. Please give accurate, current information. We may suspend an account or cancel orders if we reasonably suspect fraud, abuse, or a breach of these terms.
Products, availability & limited runs: SUDAKAI pieces are made in small, limited runs, so items and colors can sell out and may not return. We do our best to show each product accurately, but photos, colors, fit, and descriptions are for reference — actual colors can vary slightly with your screen, and small-batch items may have minor natural variation. Any size guidance is a guide, not a guarantee. We may update, restock, limit, or discontinue any product at any time.
Orders & acceptance: Placing an order is an offer to buy. Your order is only accepted once we send an order confirmation, and we may refuse or cancel an order (with a full refund) even after it's placed — for example if an item is out of stock, if there was an error, or if we suspect fraud or a breach of these terms. Once an order is in production or on its way, cancellation can't be guaranteed.
Pricing, errors & inaccuracies: Prices are shown on the product pages and can change without notice, but a change won't affect an order we've already confirmed. Despite our best efforts, the site may occasionally contain errors in pricing, descriptions, images, or availability. We may correct any error and cancel or refuse an affected order even after it's been placed, including after payment — if we cancel for this reason, you'll be refunded.
Payment: Payment is processed securely at checkout through Shopify and its payment providers. We never see or store your full card details. By placing an order you authorize the relevant processor to charge your chosen payment method for the full order amount, including shipping and any taxes. Any discounts shown on the site are applied at checkout.
Taxes & duties: Where required, sales tax is calculated and collected at checkout. You are responsible for any other taxes, duties, customs charges, or import fees that may apply to your order, especially on international shipments (see below).
Discounts, promotions & drops: From time to time we run promotions, discount codes, bundle deals (such as the SUDAKAI Stack), and limited drops. Unless we say otherwise, offers can't be combined or stacked, aren't transferable, and have no cash value. We may change, pause, or end a promotion at any time, and early access or sign-ups don't guarantee that an item will be available.
Shipping, delivery & risk: Shipping options, costs, and timeframes are described in our Shipping Policy. Delivery dates are estimates, not guarantees, and once a package is handed to the carrier, delivery timing and handling are outside our control. Please see the Shipping Policy for full details.
Correct shipping address: You're responsible for giving us a complete, accurate shipping address. If a package is returned, delayed, or lost because of an incorrect or incomplete address, any reshipment or additional shipping cost may be your responsibility, and a refund (if any) may be reduced by shipping and handling already incurred.
International orders, customs & duties: For orders shipped outside our home country, any customs duties, VAT, brokerage, or import fees charged by the destination country are not included in the price or shipping you pay at checkout, and are your responsibility. These charges are set by your local authorities and are generally non-refundable, including if a package is refused or returned.
Returns & refunds: Because our products are made in limited runs, most sales are final. Cancellations, damaged or incorrect items, and refunds are covered by our Refund Policy — please read it before ordering. If something arrives damaged or wrong, contact us and we'll make it right as described there.
Caring for your items: Please follow any care instructions provided with a product. Damage caused by improper washing, handling, or care isn't something we can replace or refund.
Intellectual property: All artwork, illustrations, designs, graphics, logos, product imagery, and written content on sudakai.co are the original work of Anh / SUDAKAI and are protected by copyright and other rights. "SUDAKAI"™ is a trademark of its owner and is the subject of U.S. Patent and Trademark Office application Serial No. 98750396 (International Class 25 — clothing and headwear); all rights are reserved. Buying a product gives you the item itself — it does not transfer any rights in the artwork or trademarks, and you may not use the SUDAKAI name, logo, or marks without our prior written permission. Otherwise, you may view and use the site for personal, non-commercial purposes only.
No copying, counterfeiting or unauthorized resale: You may not copy, reproduce, reprint, trace, or otherwise imitate our designs or artwork, or buy our products in order to copy, counterfeit, or create competing goods. Reselling SUDAKAI products in a misleading way, or passing off imitations as ours, is prohibited. We take protecting Anh's original work seriously and reserve all available rights to enforce it.
Reviews, photos & tags you share: If you submit a review, or tag or send us photos or other content (for example on social media or through our site), you grant SUDAKAI a non-exclusive, worldwide, royalty-free, ongoing license to use, display, and repost that content for marketing and promotion, including your username or handle. You confirm the content is yours to share and doesn't infringe anyone's rights. Let us know anytime if you'd like something you shared taken down.
Feedback & ideas: If you send us suggestions or ideas about our products or the site, we're grateful — but we may use them freely, without any obligation to compensate you or keep them confidential.
Emails & marketing: When you order, we'll send transactional messages such as order and shipping confirmations. We only send marketing emails if you've opted in, and you can unsubscribe at any time using the link in those emails. How we handle your information and tracking (including the Meta pixel and analytics) is described in our Privacy Policy.
Third-party services & links: Our checkout, payments, reviews, analytics, and some features rely on third parties such as Shopify, payment providers, and Meta. Your use of those services is also subject to their own terms and privacy policies, and we aren't responsible for their content, errors, or outages. We only work with providers we trust to handle your order and data responsibly.
Acceptable use: Please use the site lawfully and in good faith. You agree not to commit fraud, use bots or automated purchasing, bypass purchase or quantity limits, abuse returns, refunds, or chargebacks, infringe our or anyone else's rights, or otherwise misuse the site. We may restrict, cancel, or refuse service to protect the site, our customers, or our brand.
Chargebacks & payment disputes: If there's a problem with your order, please contact us at contact@sudakai.co first — most issues are quick to resolve. Filing a chargeback in bad faith (for example after receiving your order, or instead of following the Refund Policy) is considered abuse and may result in losing access to the store.
Disclaimers: The site and its content are provided on an "as is" and "as available" basis, without warranties of any kind except those that cannot be excluded by law. We don't guarantee that the site will always be available, error-free, or secure, and product descriptions and images are provided for general information.
Limitation of liability: To the fullest extent permitted by law, SUDAKAI and Anh will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the site or products, and our total liability for any claim is limited to the amount you paid for the order it relates to. Nothing in these terms limits any rights you have under applicable consumer-protection law.
Indemnification: You agree to reasonably cover and hold harmless SUDAKAI and Anh from claims, losses, or costs arising out of your misuse of the site, your breach of these terms, or your violation of any law or the rights of a third party.
Events beyond our control: We aren't responsible for delays or failures caused by events beyond our reasonable control — for example carrier or customs delays, supply or production issues, platform or payment outages, extreme weather, or other disruptions.
Governing law & resolving disputes: If you have a concern, please contact us first so we can try to resolve it informally — that's almost always the fastest fix. These terms are governed by the laws that apply where SUDAKAI operates, without affecting any mandatory consumer rights you have where you live. (If a specific governing-law jurisdiction is required for your region, we'll state it here.)
General: You agree to receive communications and records from us electronically, and that electronic agreements and confirmations have the same effect as if they were on paper. If any part of these terms is found unenforceable, the rest still applies. Our not enforcing a term isn't a waiver of it. You may not transfer your rights under these terms, but we may transfer ours (for example in a sale or reorganization of the business). Together with the policies referenced above, these terms are the entire agreement between you and SUDAKAI about your use of the site and your purchases.
